A NIOSH study published in August 2026 found that one in three underground coal miners with 25 or more years of experience have black lung disease. The hazard was known. The disease pathway was known. The controls were known. And yet here we are.

- Just because you are compliant does not mean you are safe. Compliance is an organizational concept. Worker protection is an individual concept. Mining is one of the most regulated industries in the United States, with its own dedicated enforcement agency in MSHA. One in three veteran miners still have black lung. - PPE is not a substitute for engineering controls. N95 masks became the default in mining because they are cheap and readily available. - Hazard and risk assessment are not static. When production methods change, the risk profile changes. Checking a box once and never reassessing is not risk management. As James puts it: if something changes in the process, you are supposed to reevaluate the hazards and the controls to confirm they are still sufficient.
